The Verkhovna Rada abolished the 1000 ha area restriction for industrial parks
On September 2, the Verkhovna Rada adopted in full draft law No. 12117 "On Amendments to Certain Legislative Acts of Ukraine to Improve the Functioning of Industrial Parks." The decision was supported by 270 members of parliament.
The document simplifies the creation and expansion of industrial sites. It also provides for the abolition of the 1000 ha area limit for these parks and the introduction of the status of "eco-industrial park."
Among other changes provided:
- clear delineation of the functions of all industrial park entities;
- the possibility for the initiator of an industrial park to simultaneously be the managing company;
- expansion of the list of activities of participants, including in the field of own electricity generation;
- the possibility of placing storages (energy storage systems) and other alternative energy facilities; introduction of the concept of an eco-industrial park;
- regulation of the placement of training centers, catering establishments, and other auxiliary infrastructure;
- improvement of procedures for changing the park’s area, transferring land ownership rights, and including or excluding the park from the Register;
- granting managing companies access to the state credit program "5-7-9."
The law also establishes requirements for separate accounting of business entities' activities, defines the procedure for compensating expenses related to the fulfillment of special obligations, and strengthens requirements for transparency of financial relations and the use of public funds.
Why this is needed
The main goal of the Law is to create conditions for the construction of new factories and the development of modern production in Ukraine. Industrial parks are an important component of the policy to develop Ukrainian manufacturers of Made in Ukraine products.
During the preparation of the document, the Verkhovna Rada Committee on Economic Development held working meetings and field events, including visits to more than 20 operating industrial parks to study the practice of using state and local incentives.
