In Kyiv, the court confirmed the demolition of unauthorized constructions on water fund land in the 'Gorbachikha' tract
The Northern Commercial Court of Appeal supported the position of the prosecutor's office and left unchanged the decision to demolish unauthorized construction objects erected on a land plot of the water fund in the 'Gorbachikha' tract in the Dnipro district of Kyiv.
According to the prosecutor's office, this concerns four residential houses, a security house, and utility buildings registered to an individual based on an arbitration court decision and a ruling of the Boryspil City District Court of Kyiv region. Subsequently, ownership rights to these properties were transferred to a public organization and later to a servicing cooperative based on purchase and sale agreements. All these buildings are located on a land plot of almost 13 hectares with a value of over 50 million UAH.
According to the prosecutor's office, the property owners tried to formalize the right to use the land plot under the unauthorized constructions. To do this, they applied to the Kyiv City Council with a petition to grant permission to develop a land management project. When they did not receive a positive response, they commissioned technical land documentation themselves.
