Divorce through the Civil Registry Office: when mutual consent is enough and why it is indispensable
Divorce at the Civil Registry Office is possible only with the mutual consent of the spouses, in the absence of common minor children and disputes over joint property. This was reported by the State Registration Department of the Ministry of Justice of Ukraine.
Divorce through the CRO
To submit an application, you need to contact any CRO, having passports and the marriage certificate with you.
If one of the spouses cannot be present in person, they have the right to prepare the application and notarize it. In this case, the other spouse submits both applications simultaneously.
After submitting the application, a one-month waiting period is established. After its completion, the spouses must again contact the CRO to register the divorce officially and receive the corresponding certificates.
Divorce through the court
Going to court is necessary in cases where the spouses have common minor children, there is no consent to divorce, or there are disputes over joint property.
The claim can be filed personally or through a representative. After the decision is made, the court sends it to the CRO at the place of the decision for entering the information into the State Register of Civil Status Acts of Citizens and making the appropriate mark in the marriage record.
