Ukrainians explained how to get divorced in a month and what documents are needed
The Department of State Registration of the Kyiv Interregional Department of the Ministry of Justice of Ukraine clarified the issue of divorce.
Divorce at the Civil Registry Office
You can submit an application for divorce to the Civil Registry Office by mutual consent, if there are no common minor children and no disputes regarding jointly acquired property.
To submit an application, you need to contact any Civil Registry Office with passports and the marriage certificate. If one of the spouses cannot personally apply to submit the application, they can fill out the application and have it notarized. In this case, the other spouse submits this application together with their own.
After 1 month from the date of application submission, upon a repeated visit to the office, the divorce registration takes place and certificates are issued.
Divorce by court decision
Spouses apply to the court in cases when they have common minor children, there is no mutual consent to divorce, or there are disputes regarding jointly acquired property. The application is submitted personally or through a representative.
The court issues a decision on divorce and sends it to the Civil Registry Office at the place of its adoption for entering information into the State Register of Civil Status Acts of Citizens and making a note in the marriage record.
How to get divorced if the spouses are outside Ukraine
The presence of spouses outside Ukraine does not create legal obstacles for divorce. To ensure uninterrupted access of citizens to Civil Registry Office services during martial law, the Cabinet of Ministers of Ukraine adopted a resolution allowing Ukrainian diplomatic missions abroad to certify divorces.
Spouses can do this in several ways:
- First – applies to couples who do not have common minor children and are in the same foreign country. In this case, the spouses need to contact the nearest Ukrainian diplomatic mission abroad and submit a joint application for termination of marriage;
- Second – relevant for couples who have common minor children or cannot submit a joint application. In this case, divorce is possible through court proceedings. For convenience, the parties can use the Electronic Court online platform to submit the corresponding application remotely.
