The Cabinet of Ministers Expanded the Powers of the Ministry of Justice Regarding the Protection of Ukraine's Interests in Foreign Courts
The Cabinet of Ministers made amendments to the regulation on the Ministry of Justice, clarifying its powers in protecting the rights and interests of the state during international disputes and court proceedings abroad.
Thus, the list of areas of state policy for which the Ministry of Justice is responsible for formation and implementation officially includes the protection of the rights and interests of Ukraine during dispute resolution, as well as the consideration of cases in foreign jurisdictional bodies involving Ukraine and foreign entities.
In particular, paragraph 1 of the Regulation on the Ministry of Justice was supplemented with a provision according to which the ministry ensures the formation and implementation of state policy not only in the field of enforcement of court decisions and the activities of the European Court of Human Rights, but also in the field of protecting the rights and interests of Ukraine during the settlement of international disputes and consideration of cases in foreign jurisdictions.
At the same time, the government removed the corresponding function from subparagraph 4 of paragraph 3 of the Regulation and allocated it to a separate subparagraph 44. Thus, the protection of Ukraine's interests in disputes involving foreign entities received the status of a separate area of state policy for which the Ministry of Justice will be responsible.
The changes aim to systematize the ministry's powers and enshrine at the normative level its role in representing and protecting Ukraine's interests during international disputes and judicial proceedings in foreign jurisdictional bodies.
