The Qualification and Disciplinary Commission of Prosecutors decided to dismiss prosecutor Mykola Martyn from the Ivano-Frankivsk District Prosecutor's Office of Ivano-Frankivsk region from his position in the prosecution authorities.

The grounds were circumstances related to the verification of the legality of the disability status established for prosecutors in Ivano-Frankivsk region following the NSDC decision dated October 22, 2024.

The Commission established that the prosecutor was assigned a Group II disability in 2017, which was repeatedly confirmed by decisions of the Medical-Social Expert Commission (MSEC). Based on this, he received a disability pension from 2017 until October 2024. However, after the expiration of the disability status in October 2024, it was not extended.

As part of a nationwide review of MSEC decisions regarding prosecutors, Mykola Martyn was summoned to the State Institution "Ukrainian State Scientific Research Institute of Medical and Social Problems of Disability of the Ministry of Health of Ukraine" to verify the validity of the previously established disability.

The first summons required his arrival at the medical institution by September 30, 2025. During this period, the prosecutor was on sick leave and informed the medical institution accordingly. Subsequently, he was sent a repeated summons demanding that he appear for examination by November 21, 2025.

According to the Commission's conclusion, after the end of his temporary incapacity, the prosecutor did not take the opportunity to undergo the examination, did not initiate approval of new deadlines, and did not take other actions to confirm the legality of the previously established disability.

The Commission concluded that "by these actions, the prosecutor demonstrated blatant disrespect for ethical standards of conduct, failed to take measures prescribed by law to preserve his own professional reputation and the reputation of the prosecution authorities. His passive stance effectively contributed to the dissemination of information that discredits the prosecution authorities, undermines public trust in the state institution, and creates an impression of tolerance for corruption risks within the system. The prosecutor did not take any active and sufficient measures aimed at confirming the legality of his disability status in a manner that would dispel reasonable public doubts and ensure the protection of the authority of the prosecution authorities."

In decision No. 247dp-26, the Commission found that Mykola Martyn committed a disciplinary offense – actions that tarnish the title of prosecutor and may raise doubts about his objectivity, impartiality, independence, honesty, and incorruptibility of the prosecution authorities; a single gross violation of prosecutorial ethics rules.

"Information regarding prosecutor Mykola Martyn of the Ivano-Frankivsk District Prosecutor's Office of Ivano-Frankivsk region receiving the status of a person with a disability, arranging a disability pension, receiving pension payments until November 2024, as well as his failure to undergo medical examination at the State Institution 'Ukrainian State Scientific Research Institute of Medical and Social Problems of Disability of the Ministry of Health of Ukraine' to verify the validity of the MSEC decision establishing his disability group — was confirmed.

Given the nature of the disciplinary offense, the Qualification and Disciplinary Commission of Prosecutors deemed it impossible for the prosecutor to continue in office and applied the most severe disciplinary sanction — dismissal from the prosecution authorities.

The decision can be appealed to the High Council of Justice or to an administrative court within one month from the date of its receipt.
