The Prosecutor from Frankivsk Region Was Not Dismissed, but His Career Opportunities Were "Cut" After Disability Verification by MSEC
The Qualification and Disciplinary Commission of Prosecutors decided to hold the prosecutor of the Kalush District Prosecutor's Office of the Ivano-Frankivsk region, Andriy Petriv, disciplinarily liable.
As stated in decision No. 250dp-26 dated June 3, the disciplinary proceedings were related to the circumstances of establishing the prosecutor's Group II disability and his subsequent receipt of pension payments.
Background
In October 2024, media reported the exposure of the head of the Khmelnytsky Regional MSEC, Tetyana Krupa, for illegal enrichment, during whose searches significant amounts of cash were found. At the same time, reports about possible abuses in the MSEC system and falsification of medical decisions began to spread publicly.
The media also reported that certain officials, including prosecutors and law enforcement officers, might have used dubious medical documents to obtain disability pensions at the expense of the budget. This caused significant public resonance and initiated inspections.
On October 22, 2024, following the results of the National Security and Defense Council, a decision was made to strengthen control over the establishment of disability for officials, which was enacted by a decree of the President of Ukraine and provided for repeated checks of MSEC decisions.
Within these measures, an inspection was initiated regarding prosecutors, including Andriy Petriv.
What is known about the prosecutor
Andriy Petriv has been working in the prosecutor's offices since October 2005. From June 12, 2024, to September 21, 2025, he held the position of prosecutor of the procedural supervision department during pre-trial investigations by territorial police bodies and public prosecution at the supervision department for law compliance by the National Police of Ukraine in the Ivano-Frankivsk regional prosecutor's office, and since September 22, 2025, he has been the prosecutor of the Kalush District Prosecutor's Office of the Ivano-Frankivsk region.
According to the decision of the Ivano-Frankivsk MSEC, in April 2020, Andriy Petriv was assigned Group II disability, which was confirmed during a scheduled review in April 2022.
Since 2020, Petriv has also been receiving a pension as a person with a disability.
Additionally, the Commission established that, according to information available in the Unified State Register of Conscripts, Reservists, and Military Obliged Persons, formed with the help of the "Diia" portal, the prosecutor was granted a deferment from military conscription during mobilization and wartime based on the requirements of Article 23 of the Law of Ukraine "On Mobilization Preparation and Mobilization."
Therefore, as part of the nationwide verification of the legality of MSEC decisions, the man was repeatedly summoned to the State Institution "Ukrainian State Scientific Research Institute of Medical and Social Problems of Disability of the Ministry of Health of Ukraine" for examination to confirm the validity of the established disability.
However, as the Commission found, despite proper notification and repeated summons, the prosecutor did not appear at the medical institution for a long time.
What the commission decided
The decision states that the prosecutor had enough time to adjust his work schedule and undergo examination at the medical institution, and no objective data was found that would have prevented his arrival for the repeated examination during the specified periods.
Therefore, the Commission believes that the prosecutor used his status as a person with a disability to receive corresponding pension payments.
The decision notes that such behavior is a passive form of facilitating the spread of information that discredits the prosecutor's office, undermines public trust in the state institution, and creates an impression of tolerance for corruption risks within the system, especially during the special legal regime of martial law.
The Commission also took into account that prosecutor Andriy Petriv, while registered for military service as a military obliged person, submitted documents to the territorial recruitment and social support center to establish Group II disability only in July 2025 — during the disciplinary proceedings' inspection. Meanwhile, the disability was officially established back in April 2020.
According to the provisions on military-medical examination in the Armed Forces of Ukraine and the List of diseases determining fitness for military service, persons with Group I or II disability are recognized as unfit for military service in peacetime and wartime and must be removed from military registration (category "unfit with removal from military registration").
In this regard, the Commission noted that having an officially established Group II disability, the prosecutor was obliged to take timely measures to be removed from military registration, as this action is a duty, not a right.
At the same time, the untimely notification of the recruitment and social support center about the existing disability and status as a military obliged person or reserved was regarded as a violation of the military registration procedure. For the prosecutor, such actions are ethically unacceptable and may create an impression of abuse or official negligence.
However, as a result, the Commission took into account the positive characterization of the prosecutor and the absence of previous disciplinary sanctions.
Based on the review, the QDCP applied a disciplinary sanction to Andriy Petriv in the form of a one-year ban on transfer to a higher-level prosecutor's office and appointment to a higher position.
The decision can be appealed to the administrative court or the High Council of Justice within one month.
