Can a public association with legal entity status have its own symbols subject to state registration
The Khmelnytskyi Interregional Department of the Ministry of Justice reported that a public association with the status of a legal entity can have its own symbols subject to state registration.
The symbols of a public association can be an emblem or a flag. They are approved by the authorized body of the association in accordance with its charter. The decision on approval must include the type of symbol, its image, and a detailed description indicating colors, scales, and proportions of the elements.
It is important that the image of the symbol contains the full or abbreviated name of the public association.
The symbols cannot reproduce state symbols of Ukraine or other countries, official symbols and insignia of government bodies, state awards, as well as other symbols and signs whose use is restricted by law. In addition, it is prohibited to use symbols of Russian imperial policy, communist, Nazi, and other totalitarian regimes, as well as symbols of the Russian Federation's military aggression against Ukraine.
Also, the symbols of a public association must differ from the symbols of other public associations that are already registered in the prescribed manner.
The use of registered symbols by third parties without the consent of the public association or for purposes unrelated to its activities is prohibited.
The state registration of symbols is carried out by the Ministry of Justice of Ukraine. The service is free of charge, and the right to use its own symbols is acquired by the public association from the date of its state registration.
