Public associations play an increasingly prominent role in the social life of Ukraine. Thousands of citizens join volunteer, professional, human rights, youth, and other organizations to implement joint initiatives and protect their interests. At the same time, participation in a public association is entirely voluntary, so every member has the right not only to join such an organization but also to terminate membership at any time. However, if a person holds a leadership position or is part of the governing bodies, simply notifying about leaving may be insufficient — in some cases, it is also necessary to ensure the relevant changes are made to the Unified State Register.

In the context of growing civil society activity in Ukraine, more and more people are joining public associations. It is important to know your rights and possibilities not only regarding joining an association but also about leaving it voluntarily.

Changes in plans, priorities, or simply lack of time — reasons for terminating membership in a public association can vary. But to ensure everything is legal and properly reflected in state registers, it is worth knowing a few important legal nuances.

How to terminate membership in a public association

According to the Law of Ukraine "On Public Associations," participation in such organizations is voluntary. This means that every person has the right to terminate membership at any time by submitting an application to the statutory body of the public association.

Importantly, membership terminates from the moment such an application is submitted and does not require additional approval, confirmation, or adoption of a separate decision by the association's governing bodies.

From the same moment, the person's powers in elected positions within the public association also cease.

When changes to the Unified State Register are required

If the membership is terminated by a person who is part of the governing body of the public association, to make the relevant changes to the information in the Unified State Register, it is necessary to submit a copy of the exit application with a mark of its acceptance.

Documents are submitted to the interregional department of the Ministry of Justice of Ukraine at the location of the legal entity's registration.

At the same time, this rule does not apply to public associations registered in the Autonomous Republic of Crimea, Donetsk, Zaporizhzhia, Luhansk, Mykolaiv, Kharkiv, Kherson, Dnipropetrovsk, Chernihiv regions, and the city of Sevastopol, for which a separate procedure for submitting documents applies.

Features of the exit of the head of a public association

The legislation provides a separate procedure for the head of a public association and their deputy.

Their membership terminates not from the moment of submitting the application but from the day following the election of new officials to the respective positions.

For state registration of such changes, documents must be submitted in accordance with the requirements of part four of Article 17 of the Law of Ukraine "On State Registration of Legal Entities, Individual Entrepreneurs, and Public Formations."

Documents for state registration must be submitted within 60 days from the date of the relevant decision.

What documents are required for state registration of changes

For state registration of changes regarding the governing bodies of a public association, it is necessary to submit:

  • an application for state registration of a legal entity — public formation (form 4). Only those pages of the application related to the relevant changes are filled out;
  • a copy of the original or a notarized copy of the decision of the authorized governing body of the public association. Usually, this is the protocol of the general meeting, conference, or board — depending on the provisions of the organization's charter;
  • a register of persons (citizens) who participated in the meeting of the general meeting, conference, or board and is an appendix to the respective protocol;
  • information about the governing bodies of the public formation, including the name, date of birth of the head and members of other governing bodies, tax identification number (if available), position, contact phone number, and other means of communication;
  • a document confirming payment of the administrative fee.

What members of public associations should remember

The law guarantees every participant in a public association the right to freely terminate membership without obtaining permission or approval from other members of the organization. However, if a person is part of the governing bodies or holds a leadership position, it is important to timely prepare the necessary documents and ensure changes are made to the Unified State Register so that the information about the organization remains current and complies with legal requirements.
