New booking rules from June: who will lose the ability to "book" due to part-time work
As already reported by the "Judicial and Legal Newspaper", the Cabinet of Ministers approved changes to the system of booking conscripts, which concern critically important enterprises, institutions, and organizations.
According to the government, the updated system aims to ensure more precise application of booking for enterprises and employees who genuinely meet the needs of the economy, defense, security, and the livelihood of the population.
One of the key innovations was raising the salary requirements. To maintain the status of a critically important enterprise and to book employees, the minimum salary level must be at least three minimum wages — 25,941 UAH. For enterprises in frontline regions, a reduced threshold will apply — 2.5 minimum wages (21,618 UAH).
The approach to accounting for employees in the booking quota has also changed. Employees who already have a deferment from conscription according to Article 23 of the Law of Ukraine "On Mobilization Preparation and Mobilization," as well as part-time employees, will be counted in the quota only at one place of work.
For example, if an employee works at one enterprise and also part-time at another, for the booking quota they will be counted only at one place of work. That is, part-time work will not create an additional spot in the booking quota for another employer.
Separately, the government clarified the procedure for determining the criticality of enterprises. Ministries, central executive bodies, and regional military administrations must reapprove their criteria for criticality within a month in coordination with the Ministry of Defense and the Ministry of Economy.
This concerns the criteria by which it is determined whether an enterprise truly has important significance for the functioning of the economy, defense capability, security, or meeting the basic needs of the population. In particular, the role of the enterprise in fulfilling state tasks, providing critical services, producing necessary products, supporting infrastructure, employment, and stable operation of communities may be taken into account.
Additionally, within three months, a review of the status of all enterprises already designated as critically important will be conducted. At the same time, during the transitional period, existing decisions on criticality and employee booking will remain in effect.
The Minister of Economy, Environment, and Agriculture, Oleksiy Sobolev, clarified that employers will have 2 months to increase salaries to the minimum required for booking. And 10 days will be given to resolve the issue of part-time work.
According to the Minister of Economy, Environment, and Agriculture, the government does not expect significant changes in the total number of booked employees, which currently amounts to about 1.4 million people.
"Just like last time, in December 2024, enterprises will be given 3 months to reconfirm their criticality. That is, by September 1, they must complete this process. The mechanism is already clear, the packages are ready, it will take no longer than last time, and reviewing the criticality of enterprises that are truly critical to the state economy once every 1.5 years under martial law seems fair to us because the situation changes," Sobolev noted.
