How to Appeal the Actions of a State Registrar – The Ministry of Justice Explained the Procedure for Filing Complaints
Consideration of complaints in the field of state registration is one of the key mechanisms for protecting the rights of citizens and legal entities. This is reminded by the Odessa Interregional Department of the Ministry of Justice of Ukraine, which notes that for the substantive consideration of an appeal, it must comply with the requirements of the legislation.
Complaints about decisions, actions, or inaction of state registrars, subjects of state registration, as well as actions or inaction of the territorial bodies of the Ministry of Justice, can be submitted to the Ministry of Justice of Ukraine and its territorial bodies.
A complaint can be submitted in written or electronic form. In case of electronic submission, the document must be signed with a qualified electronic signature or executed using electronic identification means with a high level of trust.
The appeal must specify:
- the surname, first name, and patronymic or the name of the complainant;
- place of residence or location;
- phone number and/or email address;
- details of the decision, actions, or inaction being appealed;
- circumstances justifying the violation of rights;
- complainant's demands;
- date of preparation and signature.
Documents or their copies confirming the stated circumstances may be attached to the complaint. If the appeal is submitted by a representative, documents confirming their authority must be attached.
Special emphasis is placed on the deadlines for appeal. If more than two months have passed since the decision was made or the action was taken, the complaint must indicate the date when the person became aware of the violation of their rights.
The Ministry of Justice emphasizes that complaints improperly formatted in violation of legislative requirements are returned to applicants no later than 15 days from the date of receipt. At the same time, this does not deprive the right to resubmit the appeal after correcting the deficiencies.
The Commission for the Consideration of Complaints in the Field of State Registration of the Odessa Interregional Department of the Ministry of Justice of Ukraine carries out collegial consideration of such appeals within the powers defined by law.
