A bill No. 15265-1 was submitted to the Verkhovna Rada proposing to grant individual entrepreneurs and persons engaged in independent professional activities the right to receive the state assistance for child care called “eYasla”. The main committee assigned is the Verkhovna Rada Committee on Humanitarian and Information Policy.

As stated in the explanatory note, the Law of Ukraine "On State Assistance to Families with Children" provides the right to receive the “eYasla” child care assistance for persons who actually cared for the child and returned to work full-time.

At the same time, the current version of Article 12-6 of this Law effectively extends this mechanism only to employed workers, since the criterion of "returning to work full-time" is linked to the regulation of labor relations according to labor legislation.

The explanatory note also cites the position of the State Service of Ukraine for Children’s Affairs, according to which the full-time work requirement applies exclusively to employed workers and is regulated by labor law. In contrast, the activity of individual entrepreneurs is considered business activity and does not imply a working time regime.

Therefore, the requirement to provide certificates of "full-time work" is inapplicable to entrepreneurial activity, which, as the authors of the initiative note, leads to unequal treatment compared to employed workers.

The purpose of the bill is to ensure the right of self-employed persons to receive the state assistance for child care “eYasla” on an equal footing with employed workers.

Among the main tasks of the document are eliminating legislative uncertainty regarding the right of individual entrepreneurs and persons engaged in independent professional activities to receive the “eYasla” assistance, as well as ensuring equal access to state support for parents regardless of their form of employment.

The project provides for the legislative establishment of the right to “eYasla” assistance for the mother or other legal representative of the child who actually cares for the child and is an individual entrepreneur or a person engaged in independent professional activity.

It is noted that unlike the main bill, the alternative one provides for the possibility of retroactive application of the law from the moment the right to “eYasla” assistance arises, i.e., from the beginning of 2026, to eliminate discrimination against parents.

The alternative bill also takes into account the need for self-employed persons to fulfill tax obligations.

Funding for the expenses defined by the bill is proposed to be carried out within the budget allocations for social protection of children and families for the current year.

It is expected that the adoption of the bill will ensure equal access to state support for parents regardless of their form of employment, eliminate the legal gap in the mechanism of providing “eYasla” assistance, strengthen social protection of families with children, and support the economic activity of parents engaged in entrepreneurial or independent professional activities.
