Ukraine is preparing a reform of property and real estate appraisal: what changes are proposed
The Verkhovna Rada Committee on Economic Development reviewed the revised draft law on property appraisal No. 13435 for a repeated first reading, as well as an alternative draft law on the appraisal of property, property rights, and professional appraisal activities in Ukraine No. 13435-1.
The Committee noted that during the preparation of draft law No. 13435, extensive work was carried out involving members of parliament, representatives of the professional community, and government authorities. As a result of discussions, a new version of the document was developed, which takes into account European approaches and complies with international standards in the field of property appraisal.
The document provides for the introduction in Ukraine of international and European appraisal standards, the creation of conditions for conducting real estate appraisal in accordance with global requirements, as well as the formation of an effective system of professional self-governance of appraisers through a single self-regulatory organization.
In addition, the draft law proposes to modernize the system of professional training and advanced training of appraisers, introduce fair disciplinary mechanisms, improve pre-trial dispute resolution procedures, and expand opportunities for Ukrainian specialists to work in international markets. At the same time, it envisages opening the Ukrainian market to foreign appraisers.
It is expected that the implementation of the provisions of the draft law will contribute to improving the quality and transparency of appraisal activities, the development of professional self-governance, and further harmonization of Ukrainian legislation with the norms of the European Union.
Following the review, the Committee recommended that the Verkhovna Rada adopt draft law No. 13435 as a basis in the repeated first reading with further refinement in accordance with the Parliament's Regulations. The alternative draft law No. 13435-1 was recommended for rejection.
The Committee also decided to create a working group for further elaboration of the draft law on property appraisal.
Earlier, the "Judicial and Legal Newspaper" wrote that deputies plan to adjust the procedure for property appraisal in enforcement proceedings. The proposed changes aim to systematize the responsibility of appraisers and simplify enforcement procedures in the banking sector.
