The Cabinet of Ministers approved the methodology for determining the possibility of managing seized assets
The Cabinet of Ministers approved the Methodology for determining the possibility of managing an asset (assets), developed by ARMA in accordance with the updated legislation. This was reported by ARMA.
“The adoption of the document is an important stage in the implementation of the reform of the system for managing seized assets and the introduction of new mechanisms provided by the Law of Ukraine “On the National Agency of Ukraine for Detection, Search and Management of Assets Obtained from Corruption and Other Crimes.”
The methodology establishes a unified approach to determining the possibility of effective management of seized assets and preserving their economic value. From now on, the procedure for asset evaluation will be carried out according to clear and standardized rules, which will contribute to increasing transparency and the justification of management decisions,” ARMA stated.
According to the law, to determine the possibility of effective management of an asset, ARMA, upon the prosecutor's request, conducts its identification—a set of measures aimed at establishing the characteristics and features of the asset in order to determine the most appropriate way to manage it.
The approved methodology defines the procedure for inspecting and examining assets, documenting their condition, collecting information and supporting data regarding the characteristics of the property. It also provides mechanisms for interaction with law enforcement and other state bodies to gain access to the assets.
Based on the conducted identification, ARMA will form a conclusion regarding the possibility of effective management of the asset and determine the most optimal management method. When preparing such a conclusion, the economic potential of the asset, possible sources of income, needs for material-technical and human resources, costs for storage and maintenance, as well as the comparative economic efficiency of managing the asset versus its sale, will be taken into account.
The adoption of the resolution will ensure the practical implementation of the provisions of the legislation regarding the management of seized assets, increase the efficiency of ARMA's work, and contribute to the maximum preservation of the economic value of property transferred to state management.
