Is it possible to interrupt childcare leave and reapply for it: explanation
A woman has the right, after maternity leave, to apply for childcare leave until the child reaches the age of three. This right is provided by part three of article 179 of the Labor Code of Ukraine and part one of article 18 of the Law of Ukraine "On Leaves." Both types of leave are considered social leaves.
At the same time, the legislation does not require the employee to apply for childcare leave immediately after the end of maternity leave.
Childcare leave until the child is three years old is granted at the woman's discretion. It can be used either fully or partially during the established period — until the child reaches three years of age. If necessary, the employee can interrupt such leave multiple times, return to work, and later reapply for it. This is reported by the Federation of Trade Unions.
At the same time, according to part ten of article 10 of the Labor Code, in the event of early termination of leave, the woman must notify the employer of her intention no later than 10 calendar days before the day of returning to work.
The legislation also allows applying for childcare leave starting from any day at the employee's discretion, including weekends, holidays, or non-working days. This is because the duration of leaves in Ukraine is calculated in calendar days.
At the same time, current regulations do not contain requirements for mandatory granting of such leave only from a working day, nor do they prohibit applying for it starting from a weekend, holiday, or non-working day.
