Ombudsman Lubinets reported a case of illegal detention of a person in the TRC for 50 days
The topic of so-called "busification" and the legality of the actions of employees of territorial recruitment and social support centers remains one of the most resonant in society. Against this background, a draft law was registered in the Verkhovna Rada, which provides criminal liability for illegal detention and holding of citizens in the premises of the TRC. Such actions are proposed to be punished by up to 7 years of imprisonment.
The basis for the legislative initiative were numerous reports of illegal detention and holding of citizens during mobilization measures. The problem is also evidenced by the results of inspections by the Office of the Commissioner of the Verkhovna Rada of Ukraine for Human Rights.
Thus, Ombudsman Dmytro Lubinets reported that during visits to the premises of the TRC, representatives of his office found citizens who had been there from one to several weeks without a clear legal status.
According to him, the longest recorded case of illegal stay of a person in the premises of the TRC was 50 days. At the same time, officials could not properly explain the grounds for such detention and the reasons why citizens were effectively not allowed to leave the premises.
"The longest recorded period to date of illegal stay of a person in the premises of the TRC is 50 days. And when we began to ask on what grounds you are detaining these citizens, no one could even explain what is happening and why people are not given the elementary opportunity to simply leave," said Lubinets.
Recall, the Ivano-Frankivsk District Administrative Court denied the claim of a man who challenged mobilization, claiming that he was delivered to the TRC without a summons and on the same day sent to the medical commission and conscripted into military service.
