Topless on the beach: is it allowed in Ukraine and where huge fines threaten for it

The vacation season is in full swing, and many Ukrainians are relaxing both on local beaches and abroad. Along with choosing a resort and planning a trip, questions often arise about the rules of conduct on beaches, as they can vary significantly in different countries. One of these questions is whether sunbathing topless is allowed, whether there can be liability for it in Ukraine, and what restrictions should be considered when vacationing in other countries.

The legal assessment of a specific situation depends on the place, circumstances, the behavior of the person, and whether their actions led to a violation of public order or citizens' peace.

Which laws regulate this issue

Ukrainian legislation does not contain a separate prohibition or special liability specifically for sunbathing topless.

At the same time, in certain cases the following may apply:

• Article 173 of the Code of Ukraine on Administrative Offenses (minor hooliganism);
• rules of improvement of the territorial community, if they establish the order of use of recreational zones;
• special rules for the use of certain beaches or recreational areas.

However, the mere fact of a woman being topless does not automatically constitute an administrative offense.

The question of whether the person’s actions constitute an administrative offense is decided taking into account the specific circumstances of the case. The mere fact of sunbathing topless does not automatically mean liability under Article 173 of the Code of Ukraine on Administrative Offenses.

If a person simply sunbathes on the beach, does not bother anyone, and does not commit other actions that violate public order, such behavior by itself, without other circumstances, usually does not indicate minor hooliganism.

At the same time, demonstrative nudity in places of mass gathering of people, especially outside beaches or in places where children are present, depending on the specific circumstances, may be grounds for police response.

Are there official beaches for topless sunbathing

Unlike a number of European countries, Ukrainian legislation does not provide a separate status for topless or nudist beaches.

In fact, in Ukraine there are traditional places of recreation where naturism supporters have been relaxing for many years. Ukrainian legislation does not provide a separate legal regime for nudist or topless beaches.

Therefore, even in such areas, individuals must comply with public order laws and follow the rules for using the respective territory.

The legislation on the legal regime of martial law does not establish a separate nationwide ban on topless sunbathing. At the same time, the introduction of martial law has affected the use of certain beaches and recreational areas.

In many regions of Ukraine, local military administrations and local self-government bodies:

• completely close beaches;
• determine the list of permitted swimming places;
• restrict hours of stay on the coast;
• prohibit presence on certain coastal areas due to mine danger or threat of shelling.

Therefore, it is primarily necessary to check whether visiting a particular beach is allowed at all.

If access to a beach is officially prohibited by a decision of the military administration or another authorized body, being there may be grounds for applying legally provided response measures, and in some cases – legal liability regardless of whether the person is in a swimsuit or sunbathing topless.

The highest likelihood of a conflict situation arises if a person sunbathes topless:

• in a city park;
• on the central embankment outside the beach;
• near children’s playgrounds;
• in places of mass gathering of people;
• in areas where special rules of conduct or prohibition of presence are established.

The least legal risks arise if a person:

• is on an officially open beach;
• does not violate public order;
• does not perform demonstrative or provocative actions;
• follows the rules of beach use and local authorities' requirements;
• is not in an area with restricted access during martial law.

However, even in such cases, the possibility of other vacationers contacting the police cannot be excluded. The final assessment always depends on the specific circumstances of the event.

Can local rules establish additional restrictions

Yes. Local self-government bodies approve rules for the improvement of settlements, and beach managers may establish rules for the use of certain recreational zones.

Such documents usually regulate sanitary conditions, visitor behavior, animal walking, use of sports equipment, lighting fires, and other aspects of beach use.

However, they cannot independently establish new types of administrative liability not provided for by Ukrainian laws. If a person violates lawful rules for using a particular territory, this may be grounds for stopping such violation or applying legally provided response measures.

How topless sunbathing is treated in other countries

Rules regarding topless sunbathing vary significantly depending on the country. While in most European resorts it has long been a common practice, in some countries violating clothing requirements can result in significant fines or even criminal liability.

Spain

Spain is considered one of the most liberal countries in Europe regarding topless sunbathing.

On most municipal beaches, women can sunbathe without the upper part of a swimsuit, and this is not a violation of the law. Many resorts also have official nudist beaches.

At the same time, local authorities in some cities have introduced another restriction – it is forbidden to walk around the city in a swimsuit or without clothes outside the beach. Violations of local municipal rules may result in fines.

France

In France, topless sunbathing is also a common practice at most seaside resorts.

Additionally, the country has dozens of official nudist beaches and even specialized naturist resort complexes.

Complete public nudity outside specially designated places may lead to criminal liability under French law.

Croatia

Croatia is traditionally one of the centers of European naturism.

There are dozens of FKK beaches (from German Freikörperkultur – free body culture) where fully nude recreation is allowed.

On regular tourist beaches, topless sunbathing usually does not cause objections either.

Italy

In Italy, the issue is often regulated at the municipal level.

On many beaches, women can sunbathe topless, but local authorities of some resorts have the right to establish their own beach use rules.

Moreover, the country has a significant number of official nudist beaches.

Countries with much stricter rules

When planning a vacation outside the European Union, tourists should familiarize themselves in advance with local laws. In some countries, appearance requirements are much stricter than in Ukraine or EU countries.

United Arab Emirates

The UAE has strict public morality rules.

On beaches, wearing regular swimwear is allowed, but topless sunbathing is prohibited.

Additionally, swimsuits are allowed only on the beach or near the pool. Being in a bikini in shopping centers, public transport, or city streets may be considered a violation of public behavior norms and lead to administrative or criminal consequences depending on the circumstances.

Egypt

Egypt also belongs to countries with conservative traditions.

On most public beaches, topless sunbathing is unacceptable. On the territory of international hotel chains, rules may be softer, but full nudity is not allowed.

Violations of public order or public morality norms may cause police intervention.

Tunisia

Tunisia remains a popular tourist destination, but outside resort areas more conservative behavior rules apply.

Topless sunbathing on public beaches is not recommended. At the same time, some hotel complexes may establish their own beach use rules.

Morocco

Morocco is a Muslim country where public nudity contradicts local traditions.

Even if the law does not explicitly mention topless sunbathing, such behavior may be perceived as a violation of public morality and cause law enforcement intervention.

Malta

In Malta, topless sunbathing is regulated more conservatively than in many other countries. In practice, this form of recreation is allowed mainly on certain remote beaches or places traditionally used by naturism supporters.

Bahamas

In the Bahamas, topless sunbathing and full nudity on public beaches are not allowed.

Additionally, local legislation prohibits being in a swimsuit outside the beach or pool area. Violations may result in sanctions according to local laws.

Thus, Ukrainian legislation does not contain a direct ban on topless sunbathing. At the same time, this does not mean that such behavior excludes legal consequences under any circumstances. The assessment of each situation depends on specific circumstances, location, the nature of the person’s behavior, and compliance with public order requirements.
