There is a deferral, but the children stay at home: will a single father be allowed to travel abroad
Men who independently raise minor children and have a legal right to a deferral from mobilization can not only remain exempt from conscription but also cross the state border. Current rules do not require children to necessarily accompany the father when leaving Ukraine. The main thing is to confirm the right with the appropriate documents.
Who has the right to travel abroad
During martial law, travel from Ukraine remains restricted for most men liable for military service.
One of the legal grounds for travel is having a valid deferral from mobilization. It grants the right not only to avoid being drafted into military service but also to leave Ukraine provided all necessary documents are available.
Is it necessary to take children with you
As lawyers point out, if a man independently raises minor children, including in the case of the death of their mother, he can cross the state border without the children.
This right is provided by subparagraph 2-6 of the Rules for crossing the state border by citizens of Ukraine, approved by the Cabinet of Ministers Resolution No. 57. The provision does not require the mandatory presence of children when the father leaves the country.
What documents are needed
To cross the state border, a father who independently raises children and has the right to a deferral must have:
- a foreign passport;
- an electronic military registration document (e-VOD) indicating a valid deferral;
- properly executed documents confirming the right to a deferral.
With these documents, a man can exercise the right to leave Ukraine even without accompanying his minor children.
