The Main Department of the Pension Fund of Ukraine in the Volyn region clarified the issue of applying for a disability pension.

The disability pension is granted:

- in case of disability causing full or partial loss of working capacity with the required insurance period;

- regardless of when the disability occurred: during work, before employment, or after termination of work;

- for the entire period the disability is established.

Who establishes disability?

Disability in Ukraine is established by expert teams assessing a person's daily functioning, formed in healthcare institutions.

Disability groups

Depending on the degree of loss of working capacity, there are three disability groups – I, II, III.

Disability pensions from the solidarity system

Conditions for appointment and amounts are defined by the Law of Ukraine dated 09.07.2003 No. 1058-IV "On Compulsory State Pension Insurance" (Articles 30-35).

They are assigned to people with disabilities who have an insurance period from 1 to 15 years:

FOR GROUP I DISABILITY

an insurance period from 1 to 10 years is required, depending on the age at which the disability was established:

  • up to 25 years – 1 year of insurance;
  • 26-28 years – 2 years of insurance;
  • 29-31 years – 3 years of insurance;
  • 32-34 years – 4 years of insurance;
  • 35-37 years – 5 years of insurance;
  • 38-40 years – 6 years of insurance;
  • 41-43 years – 7 years of insurance;
  • 44-48 years – 8 years of insurance;
  • 49-53 years – 9 years of insurance;
  • 54-59 years – 10 years of insurance.

After reaching retirement age 60+, 15 years of insurance period is required.

If the disability occurred during compulsory military service or as a result of injury, mutilation, concussion, or other health damage received during participation in mass public protest actions in Ukraine from November 21, 2013, to February 21, 2014 (the Revolution of Dignity), for a person who sought medical assistance between November 21, 2013, and April 30, 2014, the pension is assigned regardless of the length of acquired insurance period.

FOR GROUPS II-III DISABILITY

an insurance period from 1 to 15 years is required, depending on the age at which the disability was established:

  • up to 23 years – 1 year of insurance;
  • 24-26 years – 2 years of insurance;
  • 27-28 years – 3 years of insurance;
  • 29-31 years – 4 years of insurance;
  • 32-33 years – 5 years of insurance;
  • 34-35 years – 6 years of insurance;
  • 36-37 years – 7 years of insurance;
  • 38-39 years – 8 years of insurance;
  • 40-42 years – 9 years of insurance;
  • 43-45 years – 10 years of insurance;
  • 46-48 years – 11 years of insurance;
  • 49-51 years – 12 years of insurance;
  • 52-55 years – 13 years of insurance;
  • 56-59 years – 14 years of insurance;
  • 60+ years – 15 years of insurance.

The disability pension depending on the disability group is assigned in the following amounts:

- persons with Group I disability – 100 percent of the old-age pension;

- persons with Group II disability – 90 percent of the old-age pension;

- persons with Group III disability – 50 percent of the old-age pension.

In addition to the acquired insurance period, the period from the day the disability is established until reaching the age of 60 is counted towards the insurance period for calculating the old-age pension, from which the disability pension amount is calculated.

The disability pension is assigned from the day the disability is established if the application for pension assignment is submitted no later than three months from the day the disability is established. If the application is submitted later, the pension is assigned from the day of application.

The disability pension is assigned for the entire period the disability is established. Persons with disabilities who have reached the retirement age established by Article 26 of the Law are assigned disability pensions for life. Re-examination of these persons with disabilities is carried out only upon their request.

Disability pensions for servicemen

Conditions for appointment and amounts are defined by the Law of Ukraine dated 09.04.1992 No. 2262-XII "On Pension Provision for Persons Released from Military Service and Some Other Persons" (Articles 18-23).

They are assigned in case of disability:

- during service;

- or no later than three months after discharge from service;

- or later than three months after discharge, but due to diseases that arose during military service.

The amount of the disability pension depends on the cause of disability.

For persons disabled due to war, the pension is assigned in amounts:

I group – 100% of monetary provision sums;

II group – 80% of monetary provision sums;

III group – 60% of monetary provision sums.

For other persons with disabilities, the pension is assigned in amounts:

I group – 70% of monetary provision sums;

II group – 60% of monetary provision sums;

III group – 40% of monetary provision sums.

Disability pensions for victims of the Chernobyl disaster

The calculation procedure is defined by the Law of Ukraine dated 28.02.1991 No. 796-XII "On the Status and Social Protection of Citizens Affected by the Chernobyl Disaster" (Articles 54, 59), the Law of Ukraine dated 29.06.2021 No. 1584-IX "On Amendments to the Law of Ukraine 'On the Status and Social Protection of Citizens Affected by the Chernobyl Disaster'", and the Pension Calculation Procedure for persons affected by the Chernobyl disaster, approved by the Cabinet of Ministers of Ukraine Resolution dated 23.11.2011 No. 1210 "On Increasing the Level of Social Protection of Citizens Affected by the Chernobyl Disaster."

The pension is assigned in the amount of compensation for actual damages, based on:

- the salary received by the person in the exclusion zone in 1986-1990;

- or five times the minimum wage established by law as of January 1 of the respective year.

List of main documents

- application;

- passport;

- identification number (taxpayer registration number);

- documents on work experience acquired before January 1, 2004: employment record book, military ID, diploma of education (full-time form), and others (if the employment record book and other documents are not digitized);

- certificate of salary for any 60 consecutive calendar months of insurance period before June 30, 2000 (at the person's request or if necessary) or certificate of accrued monetary provision and paid insurance contributions (if necessary).

The Pension Fund of Ukraine adds to the application the extract from the decision of the expert team assessing the person's daily functioning on establishing disability, obtained through electronic information interaction.

How to submit documents to the Pension Fund of Ukraine?

Online:

via the Pension Fund of Ukraine electronic services web portal, Diia portal;

In person:

to the Pension Fund of Ukraine service center (regardless of registration or residence);

By mail:

if the person temporarily resides abroad, by mail to the address of the territorial body of the Pension Fund of Ukraine.
