Commercial jurisprudence has undergone a complex transformation—from state arbitration to the modern model of commercial courts, which today are an important element in ensuring the country's economic stability.

This was stated by the Head of the Supreme Court, Stanislav Kravchenko, during the opening of the two-day International Scientific and Practical Conference "Commercial Jurisdiction of Ukraine: 35 Years of Development and European Guidelines."

"The commercial court is much more than just dispute resolution. It is a space where law becomes a guarantee of stability, where trust in the investment environment is formed, and where justice acquires practical significance for the development of the state," noted Stanislav Kravchenko.

During his speech, the Head of the Supreme Court also drew attention to the challenges facing the judicial system, in particular the need to ensure its independence, institutional capacity, adaptation of legislation to modern realities, and the introduction of the latest technologies in judicial proceedings.

According to Stanislav Kravchenko, today it is important not only to evaluate the achievements of commercial judiciary but also to form a vision for its further development amid current challenges.

Further discussions will be divided into several directions:

- European standards and principles of justice. Participants will analyze the conventional right of access to court through the lens of the practice of the European Court of Human Rights and the Constitutional Court of Ukraine, as well as the implementation of the principles of the rule of law, fairness, and good faith in business disputes, land relations, and bankruptcy cases.

- Economic stability and investment climate. Special attention will be paid to the role of commercial courts as a factor in Ukraine's economic development, business trust in the judicial system, and the synergy of commercial arbitration with state courts in the context of harmonizing legislation with the requirements of the EU internal market.

- Effectiveness of enforcement of court decisions. Judges and experts will discuss enforcement of decisions as the final stage of judicial protection, cross-border enforcement in Europe, and the balance of rights between creditors and debtors.

- Judicial administration and digitalization. The second day of the conference will be dedicated to court management, optimizing judges' workloads as a factor in the quality of justice, and the development of IT tools in the justice system according to the Roadmap on the Rule of Law.

In addition to analytical sessions, within the event the National Bank of Ukraine will present a commemorative coin minted for the 35th anniversary of the establishment of commercial courts, as well as hold an award ceremony for the winners of the creative works competition and present an expert study "Jurisdictional Analysis of Judicial Control in Ukraine."

Based on the conference results, participants will formulate joint recommendations regarding further harmonization of Ukrainian legislation with EU law and defining the role of commercial jurisdiction in Ukraine's post-war recovery.

About the conference

The event brought together key representatives of the judiciary, government, parliament, and international experts. It is dedicated to the evolution of commercial judiciary from the post-Soviet model to modern EU standards.
