The Cherkasy District Court of Cherkasy region considered a case of an administrative offense and ruled to find the driver guilty of driving a vehicle under the influence of alcohol and driving without the appropriate documents. This was reported by the court.

The police drew up the first report on April 14, 2026: the driver was operating a vehicle under the influence of alcohol, which is a violation of part 2 of article 130 of the Code of Administrative Offenses. At the same time, he did not have the legally required documents to drive the vehicle, violating points 2.1.a, 2.5, 2.9.a of the Traffic Rules — responsibility for such an offense is provided by part 5 of article 126 of the Code of Administrative Offenses.

What happened next became decisive for the court in choosing the punishment: just three days later, on April 17, 2026, the same driver again came under police scrutiny for similar violations. The same police officer conducted the check, and the situation repeated exactly. The offender made no conclusions from the first incident.

The court found the driver's guilt fully proven. The case materials — two protocols of administrative offenses — together confirmed the systematic, not isolated, nature of the offender's behavior. Since one person committed several administrative offenses considered simultaneously, the penalty was assigned according to the absorption rule: punishment for the less serious offense is absorbed by the more severe one.

The court did not find any circumstances that would mitigate or aggravate responsibility under articles 34–35 of the Code of Administrative Offenses. However, the repetition — two separate facts of driving under the influence within three days — was taken into account by the court as a factor that made it impossible to limit the punishment to the minimum.

Court decision

As a result of the consideration, the court imposed an administrative penalty on the driver in the form of a fine of 40,800 hryvnias (2,400 non-taxable minimum incomes of citizens) with deprivation of the right to drive vehicles for 6 years. The court did not apply confiscation of the vehicle. In addition, a court fee of 665.60 UAH is charged from the offender. The fine must be paid within 15 days from the date of receipt of the ruling.

Road safety is not a formal requirement but a condition for preserving human life. A driver behind the wheel while intoxicated poses a real danger to all road users — passengers, pedestrians, other drivers. When such behavior repeats within a few days, the court is obliged to respond accordingly — and this is exactly what was done in this case.

The court ruling has not entered into legal force. It may be appealed to the Cherkasy Court of Appeal within ten days from the date of issuance through the Cherkasy District Court of Cherkasy region.
