The State Migration Service of Ukraine in Khmelnytskyi region filed an administrative lawsuit to detain the defendant to ensure her deportation from the territory of Ukraine with placement in a temporary accommodation center for foreigners and stateless persons. 

Circumstances of case №686/16809/26

The court established that the defendant holds a foreign passport of a citizen of the Republic of Belarus, which expired on November 23, 2011.

The defendant violated the rules for foreigners and stateless persons staying in Ukraine, namely: she did not leave the territory of Ukraine on time after the expiration of the permitted stay and did not comply with the decision on forced return to the country of origin or a third country issued by the Chemerovetskyi District Department of the State Migration Service in the Khmelnytskyi region on August 28, 2018. She does not have documents granting the right to reside in Ukraine.

As established from the case materials, the defendant does not have documents granting the right for temporary or permanent residence in Ukraine, does not have an officially registered place of residence in Ukraine, is not officially employed, and does not have documents granting the right to leave Ukraine. The court also noted that she had previously been held administratively liable for violating migration laws and a decision was made obliging her to leave Ukraine. The defendant did not comply with this decision within the specified time, continued to live in Ukraine, and did not apply in the prescribed legal manner for documents granting the right to reside in Ukraine.

What the court decided

Based on the established circumstances, the court believes there are grounds to detain the defendant for six months with placement in a temporary accommodation center for foreigners and stateless persons. 

An appeal may be filed against the court's decision.
