In Kyiv Region, Court Fined a Man for Humiliating Publications about His Ex-Girlfriend on Telegram
The Vyshhorod District Court of Kyiv region held a man administratively liable for publishing offensive posts, stickers, and other sexual content about his ex-girlfriend on a Telegram channel. The court concluded that such actions constitute an administrative offense under part 1 of article 173-7 of the Code of Ukraine on Administrative Offenses (CUAO), which establishes liability for sexual harassment, including through the use of electronic communications.
The court found that the man posted humiliating sexual materials in a publicly accessible Telegram group that insulted the honor and dignity of the victim and created a humiliating environment for her. According to the case materials, the publications included her photos, videos, and personal data. The victim reported receiving humiliating calls from strangers because of this. At the time of the events, the girl was underage.
Importantly, the offender himself confirmed in written explanations the fact of spreading such content and explained his actions as a desire to have fun. The court found him guilty under part 1 of article 173-7 CUAO and imposed a fine of 1700 UAH. Additionally, he was ordered to pay a court fee of 665.60 UAH.
Circumstances of the Case
The court established that on January 6, 2026, around 4 a.m., the man repeatedly posted offensive stickers and posts of a sexual nature about the victim in a publicly accessible Telegram group. The police drew up a protocol against him under part 1 of article 173-7 CUAO.
The victim's mother contacted law enforcement, reporting that the man was publishing humiliating photos, videos, and other materials about her daughter, as well as spreading her personal data via Telegram.
In her explanations, the victim stated that the offensive sexual posts were made by her ex-boyfriend. According to her, he used her photos and videos, and after publishing such materials, she began receiving humiliating phone calls from other people. The victim and her mother also reported that after their requests to delete the publications, the man stated he would stop only after receiving money. The court cited these explanations among the evidence in the case.
During the investigation, law enforcement obtained data indicating a possible link between the Telegram account from which the content was spread and the man's phone number. The case materials also note that he confirmed sending content that humiliated the honor and dignity of the victim, explaining his actions as a desire to have fun.
Among the evidence, the court examined the administrative offense protocol, the victim's mother's statement, explanations from the victim and her mother, police reports, the man's written explanations, as well as screenshots of messages from the Telegram channel and correspondence between the parties.
Court's Position
The court reminded that part 1 of article 173-7 CUAO provides liability for sexual harassment, i.e., intentional acts of offensive or humiliating sexual nature against a person's will, expressed verbally or non-verbally, including through electronic communications.
The ruling also cited the definition of sexual harassment from the Law "On Ensuring Equal Rights and Opportunities for Women and Men." It refers to sexual acts that humiliate a person's dignity and may create an offensive, hostile, or intimidating environment for them.
The court specifically noted that the article's disposition explicitly covers the use of electronic communications. Therefore, spreading offensive and humiliating sexual materials via Telegram can constitute this administrative offense.
After evaluating all the evidence collectively, the court concluded that the man intentionally committed offensive and humiliating sexual acts against the victim via Telegram, and thus his actions were correctly qualified under part 1 of article 173-7 CUAO. The court found the guilt proven.
Court Decision
The Vyshhorod District Court of Kyiv region found the man guilty of committing an administrative offense under part 1 of article 173-7 CUAO and imposed a fine of 100 non-taxable minimum incomes of citizens — 1700 UAH. Additionally, he was ordered to pay a court fee of 665.60 UAH.
