The Cabinet of Ministers has introduced extraterritorial checks and the involvement of authorized doctors through the electronic health system.

Thus, on Thursday, May 28, the government amended the CMU resolution dated March 3, 2023, No. 185 "On Approval of the Procedure for Persons Authorized by the Board of the Pension Fund of Ukraine to Conduct Inspections of the Justification for Issuing and Extending Sick Leave Certificates."

Accordingly, the scope of inspection was expanded (control will be exercised not only over sick leave certificates but also over the documents that form their basis, in particular, medical conclusions on temporary incapacity for work).

In addition, the mechanism for conducting inspections of medical conclusions involving authorized doctors was regulated; these doctors will be selected using the electronic health system and will work with depersonalized data.

The principle of extraterritoriality was also introduced, according to which the verification of medical conclusions is carried out by a doctor operating in a different region than where the medical care was provided.

The document also establishes requirements for the formation and maintenance of the list of authorized doctors, which is approved by the Board of the Pension Fund of Ukraine in agreement with the National Health Service of Ukraine (NHSU).

Special provisions were separately regulated for conducting inspections of sick leave certificates in paper form, as well as the procedure for documenting and sending inspection results.

The Cabinet of Ministers also clarified the procedure for appealing decisions based on inspection results in accordance with the Law "On Administrative Procedure."
