Alimony is often one of the main sources for meeting a child's needs — from food and medical treatment to education and development. Therefore, timely and full payment of such funds is of particular importance. At the same time, in practice, situations often arise when alimony is paid late, not in full, or not paid at all. In such cases, an important document is the official calculation of alimony arrears.

The calculation of alimony arrears is an official document prepared by the state executor within the enforcement proceedings. According to Article 71 of the Law of Ukraine "On Enforcement Proceedings," it specifies the monthly alimony charges, the amounts actually paid, and the total amount of arrears as of a specified date.

This document confirms the existence of the debt and can serve as a basis for applying legally provided measures against the debtor.

Who can issue the calculation of alimony arrears

Only the state executor responsible for the enforcement of the alimony recovery document has the right to issue the calculation. Information about the relevant enforcement proceeding can be checked through the Automated Enforcement Proceedings System and the Unified Debtors Register.

How to obtain the calculation of alimony arrears

To obtain the calculation, you need to submit an application to the state executor. The application should include the applicant's full name, address of residence and contact details, enforcement proceeding number, details of the enforcement document, information about the parties to the enforcement proceeding, the period for which the calculation is required, the preferred method of receiving the document, as well as the date and signature.

The application can be submitted in person to the state enforcement service body, by mail, or electronically using a qualified electronic signature.

Why the calculation of alimony arrears is needed

For the alimony recipient, the calculation of arrears allows officially confirming the amount of debt, applying to the court to recover penalties (liquidated damages), initiating the application of fines and other restrictions against the debtor, as well as using the document to receive state assistance in cases provided by law.

For the alimony payer, such a calculation also has practical significance, as it allows controlling the accuracy of charges, verifying the crediting of payments made, timely resolving issues regarding existing arrears, and protecting their rights in case of disputes.

The Ministry of Justice emphasizes that the official calculation of alimony arrears is an important tool for monitoring the fulfillment of alimony obligations, which contributes to protecting the child's rights and proper enforcement of court decisions.
