The Volyn Regional TCR explained the difference between removal and exclusion from military registration.

According to Article 37 of the Law of Ukraine "On Military Duty and Military Service," citizens of Ukraine may be subject to both removal and exclusion from military registration at district (city) territorial recruitment and social support centers.

- Exclusion from military registration is the final termination of a person's presence on the military register on grounds defined by law.

- Removal from military registration is a change of registration location or the presence of grounds after which a person may be registered for military service again.

The following categories of citizens are subject to removal from military registration:

1) From the military registration of conscripts:

▪️ who have reached the age of 25 (after which they are registered as reservists);

▪️ who have moved to another locality (administrative-territorial unit) of Ukraine and registered for military service at another territorial recruitment and social support center at the new place of residence;

▪️ who have been drafted, sent, or accepted for military service or training at vocational pre-higher military education institutions, higher military educational institutions, and military training units of higher education institutions;

▪️ who, according to Article 18 of the Law of Ukraine "On Military Duty and Military Service," have been exempted from basic military service as unfit for military service due to health reasons - after confirmation by a higher-level commission;

▪️ who have received special ranks of enlisted, sergeant, or officer personnel after graduating from educational institutions;

▪️ who have been sent to alternative (non-military) service;

▪️ who have been sent to serve sentences in penal institutions or subjected to compulsory medical measures;

▪️ who have received officer military ranks after completing military training under the reserve officers' training program.

2) From the military registration of reservists:

▪️ who have moved to another locality and registered for military service at the new place of residence;

▪️ who have been drafted or accepted for military service or training at vocational pre-higher military education institutions, higher military educational institutions, and military training units of higher education institutions;

▪️ who have been sent to serve sentences in penal institutions or subjected to compulsory medical measures;

▪️ who have been enrolled in the military operational reserve;

▪️ in other cases - by decision of the Ministry of Defense of Ukraine, the Security Service of Ukraine, or Ukrainian intelligence agencies.

3) From the military registration of reservists:

▪️ who have moved to another locality and registered for military service at the new place of residence;

▪️ who have been drafted or accepted for military service or training at vocational pre-higher military education institutions, higher military educational institutions, and military training units of higher education institutions;

▪️ who have been accepted for service in civil protection bodies and units;

▪️ who have reached the maximum age for service in the military reserve or have been excluded from the military operational reserve;

▪️ who have been sent to serve sentences in penal institutions or subjected to compulsory medical measures;

▪️ in other cases - by decision of the Ministry of Defense of Ukraine, the Security Service of Ukraine, or Ukrainian intelligence agencies.

Meanwhile, according to the same article of the Law of Ukraine "On Military Duty and Military Service," exclusion from military registration at territorial recruitment and social support centers applies to citizens of Ukraine who:

▪️ have died or have been declared missing or dead in accordance with the law;

▪️ have ceased to be citizens of Ukraine;

▪️ have been declared unfit for military service;

▪️ have reached the maximum age for reserve service;

▪️ persons aged 60+, who were candidates for military service under contract during martial law but were not accepted for contract military service;

▪️ have been discharged from contract military service due to failure to pass probation or unsuitability for service.
