Documents from the Unified State Register of Legal Entities are not issued without verification – how the procedure for obtaining information works
The procedure for providing information from the Unified State Register of Legal Entities, Individual Entrepreneurs, and Public Formations defines the process of obtaining documents contained in the registration file of a public formation. This was highlighted by the Odessa Interregional Department of the Ministry of Justice of Ukraine.
The department reminded that according to part two of article 19 of the Constitution of Ukraine, state authorities and local self-government bodies, as well as their officials, are obliged to act only on the basis, within the powers, and in the manner defined by the Constitution and laws of Ukraine.
The procedure for obtaining documents from the registration file is regulated by the Procedure for providing information from the Unified State Register of Legal Entities, Individual Entrepreneurs, and Public Formations, approved by the order of the Ministry of Justice of Ukraine No. 1692/5 dated 05.05.2023.
As noted, if the applicant wants to receive documents from the registration file in paper form, they must contact the state registration entity authorized by law to keep the relevant file.
It is also specified that during the request, the service provider verifies the identity of the applicant based on an identity document in accordance with the Law of Ukraine "On the Unified State Demographic Register and Documents Confirming Citizenship of Ukraine, Identity or Its Special Status."
Before providing the documents, their presence in the registration file is necessarily checked. Payment for the service is made after the applicant is informed about the availability of the requested documents in the case materials.
Separately, the Procedure provides that a fee is charged for providing information from the Unified State Register in cases defined by law. When receiving documents from the registration file, payment is made for each individual requested document.
