Is it necessary to resubmit documents to confirm criticality due to the controversial Government Resolution 692
As previously reported by the "Judicial and Legal Newspaper", the Cabinet of Ministers of Ukraine published Resolution No. 692, which introduced significant changes to the basic Resolution No. 76 regarding the procedure for reserving conscripted employees.
The Ministry of Economy, Environment and Agriculture explained whether enterprises need to resubmit documents to confirm criticality.
«Yes. Decisions regarding the confirmation of criticality status will be made by state authorities based on updated criteria and after receiving a complete package of documents from the enterprise,» the ministry stated.
They also clarified the issue of what happens if the reservation documents are reviewed for a long time and lose their relevance.
«The state authority must consider the enterprise's request within no more than 10 working days. To avoid delays, the enterprise needs to submit a complete and reliable package of documents,» the Ministry of Economy noted.
Regarding whether the criticality of the enterprise is maintained during the transition period, they stated that «decisions on recognizing enterprises as critically important, whose validity expires on September 1,» remain in effect.
At the same time, during the transition period, both the current criticality of enterprises and the current reservation of conscripted employees of these enterprises remain valid.
