NACP, HRCJ and CCU must coordinate detailed procedures for checking judges' declarations
In the Annual Report on the State of Ensuring Judicial Independence in Ukraine for 2025, the High Council of Justice emphasized that the fight against corruption must remain one of the state's key priorities, but it must be carried out in compliance with the principles of judicial independence and the rule of law.
The HRCJ noted that corruption undermines public trust and, consequently, the legitimacy of the judiciary as a whole.
According to the Law "On Prevention of Corruption," the procedure for a full check of judges' declarations is determined by the NACP in agreement with the HRCJ, and the agency must promptly, but no later than the next working day, inform the High Council of Justice or the Head of the Constitutional Court about the start of a full check or lifestyle monitoring.
To improve these procedures, by the HRCJ decision dated June 10, 2025, a working group was created to develop a draft procedure for conducting a full check of declarations submitted by judges.
The HRCJ believes that during the NACP's checks of judges' declarations and lifestyle monitoring, proposals from representatives of the judiciary must be taken into account. This will promote better interaction between the NACP and the courts and create the prerequisites for forming clear and understandable standards of integrity and compliance with anti-corruption legislation requirements for judges.
Additionally, the report reminded that in December 2024, the HRCJ approved Unified Indicators for assessing the integrity and professional ethics of judges. At the same time, according to the recommendations of the European Commission, some of these indicators require clarification to fully comply with European standards.
The HRCJ also noted that detailed procedures for checking property declarations and lifestyle monitoring of judges and Constitutional Court judges still need to be coordinated between the NACP, the High Council of Justice, and the Constitutional Court of Ukraine.
