In India, a man is on trial for posting a photo of a dog on the national flag
The Allahabad High Court in India has granted bail to a man accused of posting an image on Facebook of the Indian national flag with a dog sitting on it. The court also noted that "detention before trial cannot be indefinite," writes the Times of India.
According to Indian media, the case concerns Wasik Tyagi, who is accused of publishing an image that, according to the investigation, insulted the Indian national flag. Law enforcement also accused him of posting content on Facebook that allegedly contained pro-Pakistan statements.
Judge Rajiv Lochan Shukla, considering a renewed bail petition, took into account Article 21 of the Indian Constitution, which guarantees the right to life and personal liberty, as well as the fact that the accused had been in custody for about 11 months before the start of the substantive trial.
The court concluded that further prolonged detention until sentencing could contradict the principles of fair trial, and therefore decided to release the man on bail. At the same time, the criminal proceedings against him continue.
As local media note, the same accused had previously been denied bail. At that time, the court pointed to the seriousness of the charges related to desecration of the national flag and spreading provocative content on social media.
