In the United Kingdom, a lawyer who has been practicing in higher courts since 1972 was suspended from professional activity for 12 months. The reason was a breach of professional ethics and actions that, according to the disciplinary body, undermined trust in the judicial system.

He was found guilty of misconduct during a court hearing in 2022, reports Law Gazette.

What happened in the case

At the center of the case was a court injunction previously imposed on his daughter. The court prohibited her from speaking at court hearings.

Despite this, during a hearing concerning a person's death, the lawyer represented the family's interests while his daughter was present and effectively participated in preparing the statements.

How the injunction was violated

The disciplinary body established that:

  • the lawyer submitted responses in court that were prepared by his daughter;
  • he presented her instructions as his own position;
  • he effectively helped her bypass the court injunction;
  • he provided the court with inaccurate information regarding procedural matters;
  • he delayed the case proceedings due to the chaotic nature of his statements.

The decision noted that such behavior complicated the court's work and violated the principle of effective justice.

Assessment by the disciplinary body

The legal profession regulator emphasized that lawyers are obliged to act honestly and assist the court, not create obstacles to case consideration.

According to their conclusion, the lawyer's actions were serious enough to warrant a one-year suspension from practice.

Defense's position

The daughter's side stated that she did not violate the court injunction and that the disciplinary body's conclusions are erroneous. They also announced their intention to appeal the decision.
