Every year, dozens of new psychoactive substances appear on the global market, which often are not included in the lists of prohibited narcotic drugs and psychotropic substances. Due to the rapid emergence of such compounds, government authorities often face difficulties in timely detection, risk assessment, and response to potential threats to public health. To create a mechanism for prompt notification about the appearance of new dangerous substances, the Government proposes to introduce an early warning system at the legislative level.

Thus, the Cabinet of Ministers registered the draft law "On Amendments to the Law of Ukraine "On Narcotic Drugs, Psychotropic Substances and Precursors" №15287.

The draft law aims to regulate the introduction of an early warning system for new psychoactive substances.

What changes does the draft law propose

The document proposes amendments to the Law of Ukraine "On Narcotic Drugs, Psychotropic Substances and Precursors".

In particular, the law is to be supplemented with new terms:

  • "new psychoactive substance";
  • "early warning system on new psychoactive substances".

What powers will the authorized body receive

Moreover, the draft law defines the powers of the central executive body responsible for forming state policy in the field of circulation of narcotic drugs, psychoactive substances, their analogues and precursors, as well as counteracting their illegal circulation.

Its competence is proposed to include the organization of the early warning system on new psychoactive substances.

Why is the early warning system needed

The adoption of legislative changes will create legal grounds for the functioning of a mechanism for the prompt detection, collection, and dissemination of information about new psychoactive substances that may pose a threat to human life and health. Such a system should facilitate faster response by government authorities to the emergence of new dangerous substances and strengthen control in the field of their circulation.
