The Cabinet of Ministers has approved two regulations necessary for the implementation of updated legislation regarding the right of people with disabilities to work. The documents regulate the control over employers' compliance with the quota for jobs and the procedure for evaluating enterprises that may be eligible for state benefits.

The decisions were made in accordance with the Law of Ukraine No. 4219-IX, which updates approaches to the employment of people with disabilities and defines practical mechanisms for implementing these norms.

According to a government representative, barrier-free access to the labor market means not only a formal right to work but also a real opportunity for employment, proper working conditions, and professional fulfillment. For this, clear rules for employers and transparent mechanisms for their enforcement are necessary.

The first approved regulation defines the mechanism for controlling compliance with the quota of jobs for employing people with disabilities. It aims to ensure uniform application of legislative requirements, increase the effectiveness of state control, and eliminate legal uncertainty. For employers, this means clear criteria for assessing compliance and a transparent inspection procedure.

A transitional period is separately provided: state supervision measures regarding compliance with the job quota will be carried out only for the period starting from July 1, 2026. This is intended to give businesses time to adapt to the new rules.

The second regulation concerns employers who create jobs for people with disabilities and may be eligible for tax and other benefits. The document defines the procedure for assessing compliance with criteria and the procedure for issuing the corresponding conclusion.

This particularly applies to enterprises for the labor integration of people with disabilities and sheltered employment enterprises engaged in non-commercial economic activities. Based on the evaluation results, the employer will receive a conclusion on compliance with established criteria, which affects the acquisition or loss of the right to benefits.

The government emphasizes that the goal of the new rules is to make the support system more targeted. Benefits should be granted to employers who actually create jobs for people with disabilities, provide proper working conditions, and comply with legislative requirements, rather than merely formally declaring such intentions.

It is expected that the approved regulations will contribute to increasing the employment level of people with disabilities, increasing the number of relevant jobs, more transparent application of benefits, simplification of rules for employers, strengthening state control in this area, and the development of an inclusive labor market.
