A resident of Chernivtsi region was refunded 54,948 hryvnias for poor-quality metal-plastic entrance doors after she sought help from the State Consumer Service.

The woman complained about metal-plastic entrance doors manufactured by one of the enterprises. During the use of the product, she discovered a significant defect — corrosion of the paint coating, surface swelling, and the appearance of rusty spots.

The fact of ordering the doors was confirmed by a contract for their manufacture and a payment document. The consumer initially made an oral request to the business entity demanding a refund but was refused. After that, she turned to the specialists of the State Consumer Service for consultation.

The specialists explained to the applicant her rights provided by consumer protection legislation and helped prepare a written claim to the enterprise.

According to Article 8 of the Law of Ukraine "On Consumer Rights Protection," the buyer has the right to demand contract termination and a refund of the amount paid for the goods if a significant defect is found during the warranty period that arose due to the fault of the manufacturer, seller, or executor.

A significant defect is considered a defect that makes it impossible or unacceptable to use the product for its intended purpose, arose due to the fault of the manufacturer, and reappears after repair for reasons beyond the consumer's control. In addition, such a defect must have at least one of the following additional features: it cannot be repaired, requires more than 14 calendar days to fix, or significantly changes the product compared to the contract terms.

As a result of reviewing the written claim, the enterprise refunded the consumer in full — 54,948 hryvnias.

The State Consumer Service urged citizens to contact the territorial bodies of the service for consultations and protection of their legal interests in case of violation of their rights.
