Kyiv Prosecutor's Office Upheld in Appeal the Cancellation of Ownership Rights of a Panamanian Company on Real Estate on Trukhaniv Island
The Northern Commercial Court of Appeal supported the position of the Kyiv City Prosecutor's Office and left unchanged the first instance court's decision to cancel the ownership rights of a Panamanian company on two real estate objects registered on Trukhaniv Island.
As established by the prosecutors, the initial registration of the property was carried out based on a court decision that was later overturned by the appellate court. After that, the buildings repeatedly changed owners, with the last owner being a company registered in Panama.
At the same time, the Kyiv City Council did not adopt any decisions regarding the transfer of the land plot under these objects into ownership or use by any persons. In addition, the buildings were not assigned postal addresses.
The prosecutor's office emphasized that the territory of Trukhaniv Island has a special environmental protection status: it belongs to water fund lands and is reserved for the creation of a nature reserve object.
Also, during the inspection, it was established that the real estate object with an area of 1,592.5 square meters, indicated in the ownership documents, does not actually exist. Instead, other buildings and structures are located on this territory, which are used by the municipal enterprise "Pleso".
Courts of two instances agreed with the prosecutor's arguments regarding the necessity to cancel the illegal state registration of the real estate. This decision removes obstacles for the lawful disposal of the land plot by the Kyiv City Council.
