In Ivano-Frankivsk region, employees of the TRC detained a father-educator of a family-type orphanage from Donetsk region, who, together with his wife, raises eight orphans and children deprived of parental care.

After the intervention of the Verkhovna Rada Commissioner for Human Rights, the man underwent a military-medical commission and was given the opportunity to register a legal deferral. This case was reported by Ombudsman Dmytro Lubinets.

While the family was on a health retreat, the man was stopped on the street and taken to the district military commissariat and recruitment office, where he stayed for about four hours.

"We found out: the Ukrainian has a legal right to a deferral, but he did not register it on time and did not undergo the military-medical commission (MMC). After my intervention in the situation, the man passed the MMC and was given the opportunity to register the deferral through the administrative service center (ASC) in accordance with the requirements of current legislation," Lubinets reported.

The Ombudsman also drew the attention of citizens who have the right to a deferral for family reasons, including guardians, custodians, foster parents, patronage educators, and father-educators, that this right must be registered in advance.

"The state does not automatically exempt from mobilization solely based on guardianship documents. Citizens must independently and in advance initiate the registration of a deferral through the TRC, ASC, or with the help of electronic services in the 'Reserve+' application," he emphasized.

At the same time, Dmytro Lubinets stressed that responsibility for such situations lies not only with citizens who did not properly register the deferral but also with representatives of mobilization bodies who continue the practice of detentions. He once again called to stop the so-called "busification."

"Such stories repeatedly raise the issue of the need for a systemic reform of approaches to mobilization procedures and preventing situations where people with a legal right to a deferral are forced to additionally prove this right on the spot. Or when systemic cases of busification occur. It is important to improve approaches to mobilization procedures. Our task is not only to respond to specific cases but also to prevent the occurrence of similar situations in the future," Lubinets added.
