In Kryvyi Rih, an unknown person impersonated a judge's assistant and offered 'help' to a traffic violator for a bribe
The High Council of Justice reviewed a report from Judge Olga Volodymyrivna Chaikina of the Metalurh District Court of Kryvyi Rih regarding interference in her judicial activities.
Case circumstances
Judge Olga Chaikina was handling a case concerning an administrative offense under Article 130 of the Code of Administrative Offenses (driving a vehicle while intoxicated). The offender was held liable with a fine and deprivation of the right to drive vehicles for one year.
The judge learned that an unknown person made phone calls to the offender. During the conversations, the unknown individual introduced himself as Dmitry, an assistant to Judge Chaikina, and offered "help" in resolving the case for a monetary reward, claiming to be "on very good terms" with the judge.
The judge noted that there are no employees named Dmitry in the staff of the Metalurh District Court of Kryvyi Rih.
According to the judge's report, the Dnipropetrovsk Regional Prosecutor's Office entered the information into the Unified Register of Pre-Trial Investigations. The Kryvyi Rih Southern District Prosecutor's Office initiated a pre-trial investigation under Part One of Article 376 of the Criminal Code of Ukraine (interference in the activities of a judge). The investigation was assigned to the investigative bodies of the National Police.
Decision of the High Council of Justice
The High Council of Justice emphasized that it does not have the authority to carry out criminal-legal qualification of such actions, as this falls within the competence of law enforcement agencies. At the same time, the HCJ is authorized to take measures to ensure the independence of judges and the authority of justice.
Following the review, the High Council of Justice decided to appeal to the Office of the Prosecutor General with a request for information on the progress of the disclosure and investigation of the criminal offense based on the facts presented in Judge Olga Volodymyrivna Chaikina's report.
