Driver offered police officers 300 dollars after being stopped for traffic violation: how it ended
The Cherkasy District Court of Cherkasy Region considered the case of a man accused of attempting to bribe police officers to avoid administrative punishment. This was reported by the court.
The court established that during patrol of the Chervonoslobidska community territory, officers of the patrol police response sector stopped a VAZ vehicle for a traffic violation — the driver did not turn on the turn signal when changing direction. During communication, the police noticed signs of alcohol intoxication in the driver and offered him to undergo a sobriety test.
According to the case materials, to avoid the preparation of administrative materials and responsibility for traffic violations and refusal to undergo a sobriety test, the man repeatedly offered police officers an unlawful benefit.
At first, he offered money without specifying the amount, and later named the sum of 300 dollars. Despite repeated police warnings about criminal liability for such actions, the offers of unlawful benefits continued. Police officers refused any illegal proposals and documented the incident.
In the court session, the accused fully admitted his guilt. The court took into account that the circumstances of the criminal offense were not disputed by the parties, and also examined the materials collected during the documentation of the incident, including video footage from the police officer's body camera.
Evaluating the totality of evidence, the court concluded that the guilt of the accused was fully proven. The man's actions were qualified under Part 1 of Article 369 of the Criminal Code of Ukraine — offering an official an unlawful benefit for not performing actions using official position.
When imposing the sentence, the court considered that the accused had no previous convictions, has strong social ties, is not registered with a narcologist or psychiatrist, and that the committed criminal offense is classified as a minor crime. The court did not find any circumstances that would mitigate or aggravate the punishment.
As a result of the case consideration, the court found the man guilty and sentenced him to a fine of 17,000 hryvnias.
