A resident of Khmelnytskyi, who has six convictions, mostly for thefts, committed another crime. The court found him guilty of repeated theft committed during martial law (Part 4, Article 185 of the Criminal Code of Ukraine). This was reported by the Khmelnytskyi City District Court.

According to the circumstances of case № 686/6496/26, while being inside the "Eva" store on Kamianetska Street in Khmelnytskyi, the accused secretly stole two bottles of men's eau de toilette of the "Trussardi" brand with a total value of 4700 hryvnias.

The circumstances established by the court are confirmed by evidence directly examined in the court session: testimonies of the accused himself and the victim's representative, video recordings from surveillance cameras located in the store.

According to the results of the forensic psychiatric examination, the accused was aware of his actions and could control them.

He does not currently suffer from any mental illness that deprives him of the ability to understand and control his actions. He shows an emotionally unstable personality disorder, impulsive type, mental and behavioral disorders due to combined use of alcohol and cannabis, dependency syndrome, which were also present at the time of the crime attributed to him. Application of compulsory medical measures is not required.

Under these circumstances, the court found him sane and responsible for the committed act.

The accused admitted guilt, which the court recognized as a mitigating circumstance, and excluded the aggravating circumstance "recidivism" from the charges, since it simultaneously constitutes the feature of "repetition," which affects the qualification.

The Khmelnytskyi City District Court found the accused guilty of committing a criminal offense under Part 4, Article 185 of the Criminal Code of Ukraine and sentenced him to 5 years and 6 months of imprisonment. An appeal may be filed against the verdict.
