Booking only at the main place of work — companies may lose key employees
The Verkhovna Rada has explained the logic of the new rules for booking conscripts, according to which an employee will be counted in the quota only at their main place of work. It is noted that the changes are technical in nature and aimed at eliminating situations where one person is effectively counted in several companies at once.
The government's intention is that this will allow the state to see the real number of booked employees and remove mechanisms for artificially increasing quotas through part-time employment.
At the same time, parliament acknowledges that the economy operates much more complexly, and part-time employment in many fields is a normal employment model. This primarily concerns IT, medicine, education, consulting, and creative industries, where specialists often work simultaneously for several employers.
Business may lose the guarantee of access to key specialists
The new approach means that an employee will be booked only in one company — at their main place of work. For other employers, this creates additional personnel risks, as they will no longer have guarantees of access to such a specialist in case of mobilization.
Some enterprises will be able to use freed-up quotas to book other employees. However, at the same time, business becomes more vulnerable to personnel shortages, especially in sectors where there is already a lack of narrowly specialized specialists.
In fact, the new rules again raise the question of finding a balance between the needs of mobilization and the stable operation of the economy.
New criteria of criticality
As previously reported by "Judicial and Legal Newspaper", the Cabinet of Ministers revised the approaches to defining critically important enterprises, shifting the focus to financial transparency, tax discipline, and the real significance of the business for defense capability and the functioning of the state during martial law.
The main goal of the changes, according to the government, is to minimize abuses in the booking sphere and prevent the use of the status of a critically important enterprise solely as a tool to avoid mobilization.
What salaries will be required for booking
One of the key innovations was the establishment of a minimum level of official salary for booking employees.
For most enterprises, the average salary must be at least three minimum wages — 25,941 UAH. For enterprises in frontline regions, the government set a lower threshold — 21,618 UAH.
For small and medium-sized businesses, this will mean the need to revise salary policies, as well as increase expenses for unified social contributions and personal income tax to retain key employees.
All critically important enterprises in Ukraine will have their status reviewed
In addition to the new booking rules, the government announced a complete review of the status of critically important enterprises.
Ministries, central executive authorities, and regional military administrations must update the criticality criteria within a month and coordinate them with the Ministry of Defense and the Ministry of Economy. After that, within three months, the status of all enterprises that already have criticality will be reviewed.
Until the inspections are completed, the current booking and the status of critically important enterprises will remain valid. It is expected that the new rules will come into force around mid-June after the official publication of the government resolution.
