What information is required for state registration of rights to real estate objects
The Kyiv Interregional Department of the Ministry of Justice of Ukraine explained what information is necessary for the state registration of rights to real estate objects.
Points 29–30 of the Procedure for Maintaining the State Register of Real Property Rights No. 1141 define the list of information that must be entered into the State Register of Real Property Rights (SRRPR).
Regarding the real estate object, the SRRPR must include:
- the address of the object;
- the type of object; area;
- the cadastral number of the land plot;
- other technical characteristics.
Regarding the rights holder:
- surname, first name, and patronymic of the individual;
- registration number of the taxpayer's identification card;
- name and EDRPOU code of the legal entity;
- type of joint ownership and size of co-owners' shares.
Information about the title document is also mandatory:
- type of document;
- series and number;
- date of issue;
- authority or person who issued the document.
Thus, the information provided by the BTI in response to the state registrar's request must be sufficient specifically to confirm and enter this information into the SRRPR.
Electronic interaction with BTI
By the Resolution of the Cabinet of Ministers of Ukraine dated 28.04.2021 No. 509, the Procedure for obtaining information by the state registrar about the state registration of ownership rights, which are held by BTI on paper media during electronic interaction, was approved.
According to this Procedure, an authorized BTI person sends through the SRRPR:
- a form of information about the state registration of ownership rights;
- a form about the absence of state registration of ownership rights.
The ownership form must contain:
- registration number and registration date;
- information about the owner;
- information about co-owners' shares;
- details of the title document.
Transmission of such information is carried out electronically with the application of a qualified electronic signature of the authorized BTI person.
It is noted that currently not all BTI enterprises are connected to this SRRPR functionality.
Requirements for responses to paper requests
The legislation does not establish a separate unified form for BTI responses to the state registrar's paper requests. However, the absence of a special form does not mean the possibility of providing incomplete or formal information.
Regardless of the form of interaction (electronic or paper), the BTI response must contain sufficient data to:
- identify the real estate object;
- establish the rights holder;
- confirm the fact of state registration of the right;
- establish the details of the title document;
- determine the type of right and shares of co-owners.
