Neighbors make noise after 10:00 PM: what to do and how to hold them accountable
Noise from repair work, loud music, or a noisy company of neighbors can significantly disturb peaceful rest at home. If such violations occur at night or on weekends and holidays, the responsible persons may be held administratively liable.
What noise level is considered acceptable
The permissible noise level depends on the time of day, day of the week, and territorial features. For residential buildings, the average permissible noise level ranges from 30 to 45 decibels.
When noise is prohibited in residential buildings
From 10:00 PM to 8:00 AM in residential buildings and apartments, it is prohibited to:
- shout loudly and sing;
- turn on music and other sources of household noise.
Separate restrictions apply to repair work. It is prohibited to carry out repair work:
- on working days from 9:00 PM to 8:00 AM;
- on holidays and non-working days — around the clock.
At the same time, the owner or tenant of the premises where the repair is planned is obliged to notify the residents of adjacent apartments about the start of the work. If all residents of adjacent apartments agree, repair and construction work may also be carried out on holidays and non-working days.
Local authorities may establish additional rules
Local self-government bodies have the right to introduce additional requirements regarding noise compliance depending on the specifics of a particular territory. Such rules may apply, in particular, in resort, health, recreational, or protected areas.
In which cases noise is not considered a violation
The law provides a number of exceptions when noise is allowed.
In particular, restrictions do not apply if the noise is related to:
- elimination of consequences of accidents, natural disasters, or other emergencies;
- prevention of thefts, fires, or performing civil protection tasks;
- providing urgent assistance, preventing or stopping offenses;
- operation of equipment necessary to ensure the vital activity of residential and public buildings, including generators. At the same time, measures must be taken to minimize noise spread;
- holding meetings, rallies, demonstrations, and other events about which authorities or local self-government bodies have been notified in advance.
What to do if neighbors constantly make noise
First of all, try to resolve the situation peacefully and talk to the neighbors.
If this does not help, call 102. Police officers must record the violation and draw up a protocol on the administrative offense, which is the basis for holding the guilty parties accountable.
If the source of the noise is a store, cafe, construction site, or another facility located in or near the building, and its management does not respond to appeals, complaints should be submitted to local self-government bodies.
Is it possible to demand compensation through court
Citizens have the right to apply to the court demanding compensation for moral and material damage caused by systematic violation of the quiet regime.
The following evidence may be attached to the claim:
- appeals to the police;
- testimonies of neighbors;
- medical documents confirming health deterioration, nervous disorders, sleep disturbances, or other negative consequences;
- results of instrumental noise level measurements conducted by accredited laboratories.
Information about organizations authorized to conduct such measurements can be obtained from local self-government bodies.
What fines threaten for noise violations
Liability for violation of legislation on protecting the population from harmful noise impact and compliance with quiet rules is provided by Article 182 of the Code of Ukraine on Administrative Offenses.
For citizens, the following is provided:
- a warning or a fine from 85 to 255 hryvnias.
For officials and business entities:
- a fine from 255 to 510 hryvnias.
What happens in case of repeated violation
If the violation is committed again within a year, the fine amount increases.
For citizens, it is:
- from 255 to 510 hryvnias.
For officials and business entities:
- from 850 to 2550 hryvnias.
Additionally, in case of repeated violation, the law provides for confiscation of the item that became the source of noise violation.
