Is the Head of the Village Council Obliged to Pay Bonuses to Employees
The Central-West Interregional Department of the State Labor Service explained whether the head of the village council is obliged to pay bonuses to employees.
The agency reminded that according to the Cabinet of Ministers of Ukraine resolution "On the regulation of the structure and conditions of remuneration of employees of the apparatus of executive authorities, prosecutor's offices, courts, and other bodies," the head of a local self-government body has the right, within the approved wage fund, to establish bonuses for employees for high achievements at work or for performing particularly important tasks and to award bonuses to employees.
In local authorities, a bonus fund is formed (at least 10% of salaries plus savings from the wage fund). The specific conditions, procedure, and amounts of employee bonuses are determined in the bonus regulation of the respective body.
"The payment of bonuses to employees in a local self-government body belongs to the discretionary powers of the head, is a right and not an obligation, and is implemented through the adoption of relevant decisions by the local council and the development of a detailed Bonus Regulation, based on the results of work evaluation within the approved wage expenditures," the State Labor Service added.
