The High Council of Justice deprived judge Olga Datsiuk of bonuses for a month due to her inaction, which led to the release of a murder suspect
The High Council of Justice, following the review of a complaint, partially annulled the decision of the Third Disciplinary Chamber of the High Council of Justice dated May 28, 2025, on bringing judge Olga Datsiuk of the Shevchenkivskyi District Court of Zaporizhzhia to disciplinary responsibility and adopted a new decision.
The High Council of Justice presented the reasoning part of the decision in a new edition, while leaving the other parts of the Third Disciplinary Chamber's decision unchanged.
Case circumstances
Judge Olga Datsiuk was handling an indictment in a criminal proceeding concerning a defendant accused of crimes under Part Two of Article 185 (theft) and Part One of Article 115 (intentional murder) of the Criminal Code of Ukraine.
The prosecutor repeatedly filed motions to extend the preventive measure in the form of detention. However, Judge Olga Datsiuk did not consider these motions before the expiration of the previous preventive measure. As a result, the defendant was released from custody.
According to the Third Disciplinary Chamber, the judge had all grounds to consider the prosecutor's motion in a court hearing with the participation of the parties but failed to do so. Such inaction led to the impossibility of extending the preventive measure, the release of the defendant accused of a particularly serious crime, his evasion from the court, suspension of proceedings due to the search for him, and further complications in the case.
Decision of disciplinary bodies
By the decision of the Third Disciplinary Chamber of the High Council of Justice dated May 28, 2025, judge Olga Datsiuk was held disciplinarily liable and was subjected to disciplinary sanction in the form of a reprimand with deprivation of the right to receive bonuses to the judge's salary for one month.
The High Council of Justice partially amended this decision by clarifying the reasoning part but upheld the conclusion on the existence of a disciplinary offense and the applied sanction.
