Booking Over the Limit: Businesses Have Only 10 Days to Cancel Deferrals

The government clarified the duration of the status of critically important enterprises and the procedure for its re-confirmation, which will directly affect the possibility of employee booking.

As a reminder, as reported by the "Judicial and Legal Newspaper", according to Cabinet of Ministers Resolution No. 692, all decisions on designating enterprises, institutions, and organizations as critically important, adopted before June 2, 2026, remain valid only until the end of their term, but no later than September 1.

This means that by the end of summer, enterprises must undergo the procedure of re-confirming criticality according to updated criteria. A mass termination of booking on a single day is not expected, but for some employees, deferrals may end precisely on September 1 if the employer fails to confirm the status. If an enterprise does not pass re-confirmation within the specified timeframe, its critically important status is revoked, which automatically results in the loss of valid deferrals for booked employees.

The resolution also introduced updated financial criteria for confirming criticality. In particular, the average salary of employees for the last calendar month must be at least three minimum wages — 25,941 UAH before tax.

For enterprises operating in combat zones, a reduced threshold is set — 2.5 minimum wages, or 21,618 UAH.

If these requirements are not met, the enterprise will not be able to obtain the updated critically important status and will lose the ability to book personnel after September 1.

Employers Given 10 Days to Cancel Excess Deferrals

Specifically, the Ministry of Economy announced the start of inspections to ensure compliance with established booking limits for employees liable for military service. Based on information received from the Ministry of Defense, cases of exceeding the allowed booking volumes by at least one person were recorded.

In this regard, official letters are being sent to employers demanding the elimination of violations. This involves the urgent cancellation of deferrals for employees booked beyond the established limits.

According to amendments introduced by the Cabinet of Ministers Resolution No. 692 dated 30.05.2026, heads of critically important enterprises and institutions are required to submit an electronic application through the "Diia" portal to cancel the booking of such employees within 10 working days from the moment of exceeding the established limits on the number of employees liable for military service.

The letters also emphasize that the granted deferral may be canceled in case of exceeding the established limits upon the submission of the enterprise or authority head. Exceeding booking limits may be grounds for revoking the critically important enterprise status, which directly affects the possibility of further booking of employees.

Earlier, it was reported that the Verkhovna Rada raised the issue of reviewing approaches to booking employees of enterprises involved in defense needs but formally lacking direct state contracts. The Committee on National Security, Defense, and Intelligence noted that enterprises directly working for defense needs will not experience significant changes in booking approaches.

At the same time, some companies in the real sector of the economy may not meet the increased requirements, particularly regarding the average salary level considered when determining the right to book employees.
