The High Council of Justice completely annulled the decision of the Qualification and Disciplinary Commission of Prosecutors dated March 11, 2026, and closed the disciplinary proceedings against the prosecutor of the first department of the procedural supervision over pre-trial investigation and public prosecution support of the General Inspectorate of the Office of the Prosecutor General, Oleksandr Bondarenko.

The incident that became the basis for the complaint occurred on September 5, 2025, in the premises of the Office of the Prosecutor General. According to the complainant — a prosecutor of the second department of the same General Inspectorate — Oleksandr Bondarenko insulted him without reason and later used physical force: pushed the colleague, grabbed him by the neck, and tried to strangle him.

The disciplinary proceedings were initiated on the grounds of actions that tarnish the title of prosecutor, undermine the authority of the prosecution bodies, as well as gross violations of the rules of prosecutorial ethics and internal labor regulations. The Qualification and Disciplinary Commission of Prosecutors, having considered the complaint, heard explanations from the employees of the General Inspectorate and reviewed video recordings from surveillance cameras, concluded the presence of a disciplinary offense and imposed a sanction on Bondarenko in the form of a one-year ban on appointment to a higher position in the prosecution body.

The High Council of Justice did not support the commission's conclusions.

After hearing the parties, analyzing the case materials and the arguments of the complaint, the High Council of Justice concluded that the provided explanations contain significant contradictions. In particular, the testimony of witness Doroshenko does not coincide with the explanations of the complainant himself. Oleksandr Bondarenko denies his guilt. Other witnesses did not directly observe the incident and only know about it from third parties.

Regarding the video recordings referred to by the Qualification and Disciplinary Commission of Prosecutors, the High Council of Justice believes they only capture the movement of prosecutors between offices and floors but contain no evidence of unlawful actions that were the subject of the disciplinary proceedings.

"The Qualification and Disciplinary Commission of Prosecutors did not obtain clear and convincing evidence of improper behavior by prosecutor Bondarenko," the High Council of Justice stated.

As a result, the decision of the Qualification and Disciplinary Commission of Prosecutors was completely annulled, and the disciplinary proceedings were closed.
