Electronic Enforcement Documents: What Court Staff Should Also Pay Attention To
The Territorial Office of the State Judicial Administration of Ukraine in Odessa region explained what court staff should also pay attention to when working with electronic enforcement documents.
- Enforcement documents are created in electronic form without an additional application from the claimant.
After creating the electronic enforcement document card, the information is automatically sent to the User's Electronic Cabinet and displayed in the “Diia” application. Subsequently, such documents can be submitted for enforcement through automated interaction with the Automated Enforcement Proceedings System (AEPS).
- Paper and electronic forms cannot exist simultaneously.
If the claimant wishes to receive the enforcement document in paper form, they submit the appropriate application. In this case, the electronic document must be canceled, and the court issues a paper copy. The simultaneous issuance of an enforcement document in both paper and electronic forms to one person is not permitted by law.
- In case of errors detected, immediate action is required.
If inaccuracies or errors in the details are found after sending the electronic enforcement document, the court staff must cancel the created information in the court's automated document management system and generate new data with corrected information.
- Not all enforcement documents can be issued in electronic form.
If the document is subject to execution by the State Treasury Service of Ukraine, tax authorities, banking institutions, or other bodies with which electronic interaction is currently unavailable, such a document must be issued exclusively in paper form.
- Monitor the execution status.
The courts' software complexes have implemented the ability to track the movement of electronic enforcement documents and monitor their execution in the AEPS. This allows for prompt response to possible errors and ensures proper interaction between the court and enforcement authorities.
“Proper formation of electronic enforcement documents ensures faster access of citizens to justice and optimizes the working time of court staff,” the State Judicial Administration added.
