As previously reported by the "Judicial and Legal Newspaper", the Cabinet of Ministers of Ukraine published the high-profile Resolution No. 692, which introduced significant changes to the basic Resolution No. 76 regarding the procedure for reserving military liable personnel.

The government emphasized that the new rules do not cancel reservations for businesses. Their goal is to maintain a balance between defense needs and the economy, as well as to ensure that reservations are granted only to those enterprises and employees who are truly critical for the state, communities, defense, and the economy.

Main changes

Salary criterion

As explained by the Ministry of Economy, one of the key innovations is the requirement regarding the salary level. To confirm the criticality of an enterprise and to reserve an employee, a minimum accrued salary level is set – three minimum wages, which amounts to 25,941 UAH.

For enterprises operating in frontline territories, a separate condition is provided – 2.5 minimum wages, or 21,618 UAH.

Accounting for employees with part-time jobs

Employees who work part-time or already have a deferment on other grounds will be counted in the reservation quota only once – at their primary place of work. This is intended to prevent double counting of one person across different enterprises.

Review of criticality criteria

Ministries, other central executive bodies, and regional military administrations must update and approve their own criticality criteria in agreement with the Ministry of Defense and the Ministry of Economy. After that, enterprises with critical status must confirm compliance with the new requirements.

Transition period

The government has provided a transitional mechanism. The current critical status of enterprises is not automatically canceled. Until September 1, the current reservation of military liable employees of such enterprises remains in effect.

What has changed for state and municipal enterprises

Changes regarding the average salary level do not apply to state and municipal enterprises.

What a reserved employee should do

Employees do not need to independently submit documents to confirm the criticality of the enterprise. At the same time, they are advised to check the validity of the reservation with the employer, the relevance of military registration data, and their status with the responsible person.

What enterprises must do

Authorized persons must verify compliance with the updated criteria, review the lists of employees for reservation, consider part-time workers, assess salary levels, prepare documents to confirm criticality, and not delay submitting applications.
