AMCU fined a sole proprietor 30 thousand hryvnias for copying Obukhiv toilet paper packaging
The Administrative Board of the Northern Interregional Territorial Department of the Antimonopoly Committee of Ukraine fined a sole proprietor 30 thousand hryvnias for the unlawful use of product packaging design similar to the design of products by PJSC "Kyiv Cardboard and Paper Mill".
According to AMCU, the case was opened based on a complaint from PJSC "Kyiv Cardboard and Paper Mill", which complained about the actions of a competitor.
According to the complainant, the entrepreneur used the packaging design of the "Zhytomyrskyi" product, which was similar to the packaging of the "Obukhiv 65M" product. At the same time, the entrepreneur was not granted any permission to use a similar packaging design.
During the case review, the Department established that such actions could lead to confusion between the activities of the two business entities in the eyes of consumers and create unfair competitive advantages for the entrepreneur by using the business reputation of another manufacturer.
Based on the collected evidence, the Administrative Board of the Northern ITD of AMCU recognized the actions of the sole proprietor as a violation of Article 4 of the Law of Ukraine "On Protection Against Unfair Competition".
As a result of the case review, a fine of 30 thousand hryvnias was imposed on the entrepreneur.
